Textizen, a service of GovDelivery, Inc. (“Textizen,” “we” or “us”), wants you to be familiar with how we collect, use and disclose information. This Privacy Policy describes our practices in connection with information that we collect through websites operated by us from which you are accessing this Privacy Policy (the “Sites”), through our social media pages (our “Social Media Pages”), as well as through the services that we provide to city officials, community leaders, local organizations and others, to help them to receive feedback from citizens, which include, but are not limited to, SMS-based surveys or any other survey provided by Textizen’s platform (the “Services”), including through the software applications made available by us for use on or through computers and mobile devices (the “Apps”), as well as through HTML-formatted email messages that we send to you that link to this Privacy Policy (collectively, including the Sites, the Apps and our Social Media Pages, the “Services”). By using the Site or Services, you agree to the terms and conditions of this Privacy Policy.

Personal Information

Personal Information We Collect

“Personal Information” is information that identifies you as an individual, which includes, but is not limited to:

  • Name
  • Organization name
  • Telephone number, including your mobile phone number
  • Email address
  • Mailing address

We may combine your Personal Information with information that we receive from and about you, online and offline, including from third parties.

How We Use Personal Information

We may use Personal Information: to provide the Services to you.

  • to permit you to participate in the Services, including to allow you to respond to surveys and to contact you with follow-up questions and information.
  • to respond to your inquiries and fulfill your requests.
  • to send you important information regarding the Site, our Services, changes to our terms, conditions and policies and other administrative information.
  • to personalize your experience of the Site and our Services, such as by presenting offers tailored to you.
  • to allow you to send messages to a friend through the Site. By using this functionality, you are telling us that you are entitled to use and provide us with your friend’s name and email address.
  • for our business purposes, such as data analysis, audits, developing new products and services, enhancing the Site, improving the Services, identifying usage trends and determining the effectiveness of our promotional campaigns.

How Personal Information is Disclosed

Your Personal Information may be disclosed:

  • to our clients who use the Services, who are contractually prohibited from sharing it.
  • to our affiliates for the purposes described in this Privacy Policy.
  • to our third party service providers who provide services such as website hosting, data analysis, infrastructure provision, IT services, customer service, email delivery services, auditing services and other similar services, to enable them to provide services.
  • to identify you to anyone to whom you send messages through the Site.

“Other Information” is any information that does not reveal your specific identity or does not directly relate to an individual, such as:

  • Browser information
  • Information about your mobile device
  • Information collected through cookies, pixel tags and other technologies
  • Survey responses, demographic information and other information provided by you
  • Aggregated information
  • Search terms

How We Collect Other Information

We and our third party service providers may collect Other Information in a variety of ways, including:

  • Through your browser: Certain information is collected by most browsers, such as your Media Access Control (MAC) address, computer type (Windows or Macintosh), screen resolution, operating system version, Internet browser type and version, referring webpage and pages visited. We use this information to ensure that our Services functions properly.
  • Through your use of the Services on a mobile device: When you respond to a survey or otherwise submit feedback to us, we automatically collect your phone number and the identity of your mobile carrier?.
  • Using cookies: Cookies are pieces of information stored directly on the computer that you are using. Cookies allow us to collect information such as browser type, time spent on the Site, pages visited and language preferences. We and our service providers use the information for security purposes, to facilitate navigation, to display information more effectively, and to personalize your experience while using our Service, as well as for online tracking purposes. We also use cookies to gather statistical information about the usage of the Site and Services in order to continually improve their design and functionality, understand how they are used and to assist us with resolving questions. If you do not want information collected through the use of cookies, there is a simple procedure in most browsers that allows you to decline the use of cookies. If you choose to decline cookies, some or all of the features, functionality and promotions available through the Site may not be available to you.
  • Using pixel tags and similar technologies: Pixel tags (also known as web beacons and clear GIFs) may be used in connection with some Site pages and HTML-formatted email messages to, among other things, track the actions of Site users and email recipients, measure the success of our marketing campaigns and compile statistics about Site usage and response rates.
  • IP Address: Your “IP Address” is a number that is automatically assigned to the computer that you are using by your Internet Service Provider (ISP). An IP Address is identified and logged automatically in our server log files whenever a user visits the Site, along with the time of the visit and the page(s) that were visited. We use IP Addresses for purposes such as calculating Site usage levels, helping diagnose server problems, and administering the Site.
  • Physical Location: We may collect the physical location of your device by, for example, using satellite, cell phone tower or WiFi signals. We may use your device’s physical location to provide you with personalized location-based services and content. We may also share your device’s physical location, combined with information about what advertisements you viewed and other information we collect, with our marketing partners to enable them to provide you with more personalized content and to study the effectiveness of advertising campaigns. In some instances, you may be permitted to allow or deny such uses and/or sharing of your device’s location, but if you choose to deny such uses and/or sharing, we may not be able to provide you with the applicable personalized services and content.
  • From you: Your responses to surveys and other information are collected when you voluntarily provide the information. Unless combined with Personal Information, this information does not personally identify you.
  • By aggregating information: Aggregated Personal Information does not personally identify you. For example, we may aggregate Personal Information to calculate the percentage of survey respondents who have a particular telephone area code.
  • Search terms: We log the searches you perform on the Site, in order to learn more about how the Site is used and how we may improve it.

How We Use and Disclose Other Information

We may use and disclose Other Information for any purpose, except where we are required to do otherwise under applicable law. If we are required to treat Other Information as Personal Information under applicable law, then, in addition to the uses listed in the “How We Collect Other Information” section above, we may use and disclose Other Information for all the purposes for which we use and disclose Personal Information.

In some instances, we may combine Other Information with Personal Information. If we do, we will treat the combined information as Personal Information as long as it is combined.


Third Party Sites

This Privacy Policy does not address, and we are not responsible for, the privacy, information or other practices of any third parties, including any third party operating any site to which the Site contains a link. The inclusion of a link on the Site does not imply endorsement of the linked site by us or by our affiliates.

Please note that we are not responsible for the collection, usage and disclosure policies and practices (including the data security practices) of other organizations, such as Facebook, Apple, Google, Microsoft, RIM or any other app developer, app provider, social media platform provider, operating system provider, wireless service provider or device manufacturer, including any Personal Information you disclose to other organizations through or in connection with the Apps or our Social Media Pages.


Security

We use reasonable organizational, technical and administrative measures to protect Personal Information under our control. Unfortunately, no data transmission over the Internet or data storage system can be guaranteed to be 100% secure. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of any account you might have with us has been compromised), please immediately notify us in accordance with the “Contacting Us” section below.


Choices and Access

Your choices regarding our use and disclosure of your Personal Information

We give you choices regarding our use and disclosure of your Personal Information for marketing purposes. You may opt out from:

  • Receiving marketing emails from us: If you no longer want to receive marketing emails from us, you may opt out of receiving them by following the instructions contained in each such email or changing your account preferences . If you opt out of receiving marketing messages from us, we may still send you important administrative messages.
  • Our sharing of your Personal Information with affiliates for their marketing purposes: If you would prefer that we not share your Personal Information on a going-forward basis with our affiliates for their marketing purposes, you may opt out of this sharing by writing to hello@textizen.com.

We will try to comply with your request(s) as soon as reasonably practicable. Please note that if you opt out as described above, we will not be able to remove your Personal Information from the databases of our affiliates or unaffiliated third parties with which we have already shared your Personal Information.

How you can access, change or suppress your Personal Information

If you would like to review, correct, update, suppress, delete or otherwise limit our use of the Personal Information you have provided to us, you may contact us by writing to: hello@textizen.com.

In your request, please make clear what information you would like to have changed, whether you would like to have your Personal Information suppressed from our database or otherwise let us know what limitations you would like to put on our use of your Personal Information. We will try to comply with your request as soon as reasonably practicable. You may also be able to access your online profile and other personal details through the Site, so that you can update them yourself.


Retention Period

We will retain your Personal Information for the period necessary to fulfill the purposes outlined in this Privacy Policy unless a longer retention period is required or allowed by law.


Use of the Site by Children

The Site is not directed to individuals under the age of thirteen (13), and we request that these individuals not provide Personal Information to us.


Jurisdictional Issues

The Site and the Services are controlled and operated by us from the United States and are not intended to subject us to the laws or jurisdiction of any state, country or territory other than that of the United States.


Cross-border Transfer

Your Personal Information may be stored and processed in any country where we have facilities or in which we engage service providers, and by using the Site and/or Services, you consent to the transfer of information to countries outside of your country of residence, including the United States, which may have different data protection rules than in your country.


Sensitive Information

We ask that you not send us, and you not disclose, any sensitive Personal Information (e.g., Social Security numbers, information related to racial or ethnic origin, political opinions, religion or other beliefs, health, criminal background or trade union membership) on or through the Site or Services or otherwise to us.

We may change this Privacy Policy. The “LAST UPDATED” legend above indicates when this Privacy Policy was last revised. Any changes will become effective when we post the revised Privacy Policy on the Site. Your continued use of the Site and/or Services following these changes means that you accept the revised Privacy Policy.
